Questions
Asked before the first project
Short answers to what founders and artists ask most. Your situation may need a longer one.
What do you charge?
Most work is a fixed fee, quoted in writing before I start: a clearance search and opinion, for example, or a federal application priced per class. The office's own fees are separate. Each stage's page shows which pieces are fixed and which are quoted.
Do you handle patents?
No. Patent applications need a registered patent practitioner, and I refer inventors to ones I trust. I can still help with the brand, the design files and any licensing around the invention.
What's the difference between ™ and ®?
Anyone can use ™ on a name they use in business. The ® is only for a mark registered with the federal office, and using it before registration can cause problems.
How long does a trademark application take?
Usually many months, sometimes more than a year, depending on the office's backlog and whether the examiner raises questions. I tell you each time something happens.
Do I need a registration to own a name?
Using a name in business gives you some rights where you use it. A federal registration gives you much stronger ones across the country, and makes takedowns and disputes simpler.
Can you help if I'm outside New York?
Federal trademark and copyright filings can be handled for clients anywhere in the country. For state-law questions or court cases elsewhere, I work with local counsel.
Will you tell me if I don't need you?
Yes. Some names don't need a search, and some contracts are fine as written. I'd rather say so than bill for it.

Write it down and send it. If the answer is short, I'll just answer it.
